These Terms of Service ("Terms") govern your use of the Sa3erha سعّرها mobile application ("the App"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms within the App and updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
We aggregate deals and promotional offers as published by the respective retailers. The content displayed in the App is sourced from publicly available promotional materials. Each flyer published in the App includes a "Source" ("المصدر") link at the bottom, directing users to the original source of the promotional material.
The display of a retailer's flyer, logo, or brand name within the App does not imply any affiliation, partnership, endorsement, or sponsorship by that retailer unless explicitly stated. All trademarks, logos, and brand names displayed in the App are the property of their respective owners.
We make reasonable efforts to ensure accuracy but do not guarantee it. Deal information displayed in the App, including product names, prices, discounts, availability, and validity dates, is sourced from retailers' published promotional materials. While we implement a multi-level auditing process to verify the accuracy of listed information against the original published offers, errors may occur.
Specifically, we do not guarantee that:
(a) Prices shown in the App are current or accurate at the time of your visit to the store;
(b) Products shown are in stock or available at any particular store location;
(c) Promotional offers have not been modified, extended, or withdrawn by the retailer after being published in the App;
(d) Offer validity dates are accurate, as retailers may change dates without notice.
You acknowledge that you should verify all deal information, including prices, availability, and validity dates, directly with the retailer before making any purchasing decisions. We encourage you to use the "Source" link provided with each flyer to view the original promotional material.
If you notice any inaccuracies in the deals or information displayed in the App, we encourage you to report them to us at [email protected]. We will review and correct confirmed errors promptly.
You may use the App without creating an account. However, certain features, such as syncing your shopping list across devices, require account registration. You can register using your phone number (with OTP verification), Apple Sign-In, or Google Sign-In.
If you create an account, you are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms. You may delete your account at any time by contacting us at [email protected]
You agree to use the App only for its intended purpose: browsing deals, managing shopping lists, and related personal, non-commercial activities. You agree NOT to:
(a) Scrape, crawl, copy, or extract data from the App using automated tools, bots, scripts, or any other automated means;
(b) Reproduce, redistribute, republish, or commercially exploit any content from the App, including flyer images, product information, or pricing data;
(c) Reverse engineer, decompile, or disassemble the App or any part of its underlying technology;
(d) Use the App to create a competing product or service;
(e) Interfere with or disrupt the App's infrastructure, servers, or networks;
(f) Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
(g) Use the App for any unlawful, fraudulent, or malicious purpose;
(h) Attempt to gain unauthorized access to any part of the App, other accounts, or systems connected to the App.
Violation of these terms may result in immediate termination of your access to the App.
The App, including its design, code, features, user interface, and any original content created by us, is the intellectual property of Sa3erha سعّرها mobile application and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
Flyer images, product names, brand logos, and promotional content displayed in the App are the property of their respective owners (retailers and brands). We display this content for informational purposes, aggregated from publicly available sources, and we attribute the source of each flyer within the App.
The App displays banner advertisements. These advertisements are clearly labeled as "Ad" or "إعلان" in Arabic. We are responsible for reviewing and approving all advertisement content displayed in the App. However, we do not endorse the products, services, or claims made in any advertisement. Clicking on an advertisement may direct you to a third-party website or content, which is governed by that third party's own terms and privacy policy.
The App provides a shopping list feature that allows you to save items for your reference. This feature is provided for convenience only. We do not guarantee the continued availability of any item on your list, and the shopping list does not constitute a reservation, hold, or guarantee of any product at any store.
The App uses your device's location (with your permission) to show nearby stores and relevant deals. Location data is processed as described in our Privacy Policy. You can disable location services at any time through your device settings. The App will remain functional with manual city selection.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that:
(a) The App will be available at all times, uninterrupted, or error-free;
(b) The information, content, or deals displayed in the App are accurate, complete, current, or reliable;
(c) Any particular deal, price, or offer will be honored by any retailer;
(d) The App will meet your specific requirements or expectations.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(a) We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, including but not limited to: losses resulting from reliance on deal information, prices, or availability displayed in the App; losses resulting from inability to access or use the App; damages resulting from any third-party content, advertisements, or links accessed through the App.
(b) Our total aggregate liability to you for any claims arising from or related to your use of the App shall not exceed the greater of: (i) the total amount you have paid us in the twelve (12) months preceding the claim, or (ii) ten Jordanian Dinars (10 JOD).
(c) We are not liable for any actions, omissions, products, services, or promotions of any retailer, brand, or advertiser whose content appears in the App.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Sa3erha سعّرها mobile application and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use or misuse of the App; (b) your violation of these Terms; or (c) your violation of any applicable law or regulation.
The App may contain links to third-party websites, services, or content (including through advertisements and source links). We do not control and are not responsible for the content, privacy practices, or availability of any third-party services. Your interaction with third-party services is governed by their respective terms and policies.
These Terms shall be governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent courts in Amman, Jordan.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App, and supersede any prior agreements or understandings.
